These Terms & Conditions define the operation of the online store lavita-lab.com, the rights of the buyer, and the business relationship between the provider and the buyer. They are binding from the moment you enter our online store. By placing an order, you confirm that you are familiar with and agree to these Terms & Conditions.
Lavita-lab.com reserves the right to change these Terms & Conditions at any time without prior notice. Changes take effect upon publication and are binding for users.
Prices
All prices in the online store lavita-lab.com are listed in euros (€).
Promotional offers are valid while stocks last.
Prices are subject to change without prior notice.
We are VAT registered; VAT is included in the price and indicated on the invoice.
Orders
All orders placed through the online store are considered final and will be processed. The sales contract between lavita-lab.com and the buyer is concluded at the moment when lavita-lab.com sends the first email confirming the order (subject: order confirmation).
From that moment, all prices and conditions are fixed and apply to both parties. The buyer is the person whose details are provided at the time of placing the order. Changes to buyer details after submission are not possible.
Please carefully review your order details before submission, as modifications are not possible afterward.
Information about concluded contracts or submitted orders is available to the buyer in their user account or in our database. Orders can also be placed by phone or email.
The website operates in Slovenian and English, and contracts can be concluded in both languages.
Complaints and Withdrawal from Contract
The buyer has the right to withdraw from the contract within 14 days of receiving the goods, without stating a reason. The withdrawal notice is considered timely if submitted within the deadline.
The buyer must return the goods within 14 days after notifying the seller. The buyer bears all shipping and return costs.
Refunds will be issued after the returned goods have been received and it has been verified that they are undamaged and in unchanged quantity. Refunds will be issued as soon as possible, and no later than 14 days after receiving the withdrawal notice. Refunds will be made using the same payment method unless otherwise agreed, with no additional cost to the buyer.
The buyer must include the invoice, personal details, and bank account information for the refund.

Non-Conformity of Goods
The buyer may request replacement with a defect-free product or exercise rights under statutory provisions for non-conformity.
1. The seller must deliver goods in accordance with the contract and is liable for material and legal defects.
2. A defect is considered material if:
- the product lacks properties necessary for normal use or trade;
- the product lacks properties required for specific use known to the seller;
- the product lacks agreed or prescribed characteristics;
- the product does not match a sample or model, unless shown for reference only.
3. Suitability of the goods for normal use shall be assessed in relation to ordinary goods of the same type and taking into account any statements made by the seller or the manufacturer regarding the characteristics of the goods, in particular through advertising, product presentation, or indications on the goods themselves.
4. Liability for material and legal defects is governed by the provisions of the law regulating contractual (obligations) relationships, unless otherwise provided by law.
- Article 37.a
- The consumer may exercise their rights arising from a material defect if they notify the seller of the defect within two months from the date the defect was discovered.
- The consumer must describe the defect in detail in the notification and allow the seller to inspect the item.
- The consumer may notify the seller of the defect in person, for which the seller must issue a confirmation, or send it to the store where the item was purchased, or to the seller’s representative with whom the contract was concluded.
- Article 37.b
- The seller is not liable for material defects in goods that appear after two years from the date of delivery.
- If the subject of the contract between the seller and the consumer is a used item, the seller is not liable for material defects that appear after one year from the date of delivery.
- It is presumed that a defect existed at the time of delivery if it appears within six months from delivery.
- Article 37.c
- A consumer who has properly notified the seller of a defect has the right to require the seller to:
- remedy the defect in the goods; or
- refund a proportionate part of the paid amount; or
- replace the defective goods with new, faultless goods; or
- refund the full amount paid.
- In all cases, the consumer also has the right to claim compensation for damages from the seller, including reimbursement of costs for materials, spare parts, labor, transfer, and transportation of products incurred in fulfilling the obligations referred to in the previous paragraph.
- The consumer’s rights from the first paragraph expire two years from the date they notified the seller of the material defect.
- A consumer who has properly notified the seller of a defect has the right to require the seller to:
Exceptions to the Right of Withdrawal
The buyer does not have the right to withdraw from contracts involving:
- goods or services whose price depends on market fluctuations beyond the seller’s control and which may occur within the withdrawal period;
- goods made according to the consumer’s precise instructions and adapted to personal needs;
- goods that are perishable or expire quickly;
- services that have been fully performed, where performance began with the consumer’s express prior consent and acknowledgment that the right of withdrawal is lost once the service is fully performed;
- the supply of sealed audio or video recordings and computer software, if the seal has been broken after delivery;
- the supply of newspapers, periodicals, or magazines, except for subscription contracts for such publications;
- the supply of sealed goods that are not suitable for return due to health protection or hygiene reasons, if the seal has been broken after delivery;
- the supply of goods which, by their nature, are inseparably mixed with other items;
- the supply of alcoholic beverages whose price was agreed at the conclusion of the sales contract and which can be delivered after 30 days, where the actual value depends on market fluctuations beyond the seller’s control;
- contracts concluded at public auction;
- contracts where the consumer expressly requested a home visit by the company for urgent repair or maintenance; if additional services or goods not expressly requested are provided, the consumer retains the right of withdrawal for those additional services or goods;
- accommodation not intended for permanent residence, transport of goods, vehicle rental, food preparation and delivery, or leisure services, where the company undertakes to perform its obligation on a specific date or within a specific period;
- the supply of digital content not supplied on a tangible medium, where performance began with the consumer’s express prior consent and acknowledgment that the right of withdrawal is thereby lost.
Order Refusal
The online store lavita-lab.com reserves the right to refuse an order if it cannot be fulfilled under the stated conditions or with the available information.
Order Processing
Order processing begins immediately after receipt of the order. In the case of payment by bank transfer, order processing begins after the funds have been received.
Payment Methods
The provider offers the following payment options:
- bank transfer (UPN form) to Fortix d.o.o., Moste 92h, Komenda;
- credit card payment.
Shipping
Shipping costs are charged according to the current price list of GLS d.o.o., depending on the buyer’s selection.
Goods will be dispatched as soon as possible, and no later than two (2) working days after payment is received.
Disclaimer
The provider makes every effort to ensure that the information published on the website is accurate and up to date. However, product characteristics, delivery times, or prices may change so quickly that the provider may not be able to update the website in time.
In such cases, the provider will inform the buyer of the changes and allow the buyer to withdraw from the order or replace the ordered item. Although the provider strives to provide accurate product images, all images should be considered symbolic.
Complaint Procedure
At lavita-lab.com, we strive for customer satisfaction and the continuous improvement of our online store operations. We comply with consumer protection legislation and aim to provide a user-friendly shopping experience. However, mistakes may occur, and the service provided may occasionally differ from your expectations.
If you wish to submit a complaint regarding our business operations, you may do so in several ways. We do not wish for disputes to arise and therefore make every effort to resolve them amicably.

We will respond to your complaint as soon as possible and no later than within 30 days of receipt. For any additional information regarding the complaint procedure, you may contact us at +386 70 555 356. The competent court for all unresolved disputes is the local district court.
In accordance with applicable legal regulations, Fortix d.o.o. does not recognize any out-of-court consumer dispute resolution provider as competent for resolving a consumer dispute that a consumer may initiate under the Act on Out-of-Court Resolution of Consumer Disputes.
